Please read these Terms and Conditions ("Terms") carefully before using the Desert Sky Roofing website at dsrroofcoatingtucson.com (the "Site"). These Terms govern your access to and use of the Site and the services offered by Desert Sky Roofing ("Company," "we," "us," or "our"), operated by Desert Sky Construction LLC, licensed in the State of Arizona (ROC R-62 #337402; CR-42 #356394). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Site.

1. Acceptance of Terms

By accessing, browsing, or using our Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all visitors, users, and any other persons who access or use the Site.

2. Services

Desert Sky Roofing provides residential and commercial roofing services throughout the Tucson, Arizona metropolitan area, including roof coatings (elastomeric systems), roof repairs, shingle roof replacement, tile roof replacement, tile underlayment replacement, emergency roof repairs, skylight repair and replacement, fascia repairs, and roof inspections. The content on our Site is provided for general informational purposes only. No content on the Site constitutes a binding offer, warranty, or contract for services. All service agreements are formalized through a separate written proposal or contract signed by both parties.

3. Licensing and Credentials

Desert Sky Roofing operates under the following Arizona Registrar of Contractors (ROC) licenses held by Desert Sky Construction LLC:

• R-62 ROC License #337402 — Residential Roofing
• CR-42 ROC License #356394 — Commercial Roofing

Desert Sky Roofing is also a certified Master Applicator through Tucson Rubberized Coatings and is trained and certified by the Tile Roofing Industry Alliance. References to these credentials on the Site are made for informational purposes only and do not constitute a guarantee of outcome for any specific project.

4. Use of the Site

You agree to use this Site only for lawful purposes and in a manner consistent with all applicable local, state, and federal laws. You agree not to:

• Violate any applicable law or regulation in connection with your use of the Site.
• Transmit unsolicited commercial messages (spam) through any form or contact channel on the Site.
• Attempt unauthorized access to any part of the Site, its servers, or any connected systems or networks.
• Use automated scripts, bots, scrapers, or other tools to collect data from the Site without our express written permission.
• Post, upload, or transmit any content that is defamatory, obscene, fraudulent, or otherwise unlawful.
• Impersonate any person or entity, or misrepresent your identity or affiliation.

5. Contact Forms and Consultation Requests

When you submit a contact form or consultation request on our Site, you represent that the information you provide is accurate, current, and complete. Submission of a form does not guarantee a scheduled appointment, a quote, or that we will enter into a service agreement. A Desert Sky Roofing representative will contact you to confirm your request and determine next steps. We reserve the right to decline any service request at our sole discretion.

6. Estimates and Proposals

Any pricing ranges, examples, or general cost information provided on our Site or during an initial phone inquiry are for general reference only and are not binding. A formal written proposal will be prepared following a physical inspection of your property by a qualified Desert Sky Roofing representative. Final pricing may vary based on roof type, scope of work, materials required, and site-specific conditions identified during inspection. All proposals expire 30 days from the date of issue unless otherwise stated in writing.

7. Warranties

Specific workmanship and material warranties are provided through separate written warranty documents issued in connection with completed service agreements. Nothing on this Site constitutes or implies a warranty of any kind regarding services not yet contracted. Warranty terms, eligibility, and coverage are subject to the specific written warranty documentation provided at the time of project completion.

8. Intellectual Property

All content on this Site, including but not limited to text, photographs, logos, graphics, video, and page layout, is owned by or licensed to Desert Sky Roofing and is protected by applicable U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, publicly display, modify, or create derivative works from any content on this Site without our prior written consent, except for personal, non-commercial use (such as printing a page for your own reference).

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, AND FUNCTIONALITY PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. 10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE ARIZONA AND FEDERAL LAW, DESERT SKY ROOFING, ITS OWNER, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON THIS SITE OR ITS CONTENT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Desert Sky Roofing, Desert Sky Construction LLC, its owner, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising from or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Pima County, Arizona. You hereby consent to the exclusive personal jurisdiction of those courts.

14. Dispute Resolution

Prior to initiating any formal legal action, you agree to provide Desert Sky Roofing with written notice of your dispute at the address listed in Section 16, including a description of the issue, the relief you seek, and your contact information. We will attempt to resolve the dispute informally within thirty (30) calendar days. If no informal resolution is reached, either party may pursue all available legal remedies.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted to the Site with a revised Effective Date. Your continued use of the Site following any posted modifications constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should discontinue use of the Site.

16. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any executed written service agreement between you and Desert Sky Roofing, constitute the entire agreement between the parties with respect to your use of the Site and supersede all prior representations, understandings, and agreements, whether written or oral.
